These Terms and Conditions set out the basis on which Man and Van Southgate provides removal, transport and related services. By making a booking or allowing work to commence, you agree that you have read, understood and accepted these Terms and Conditions. If you do not agree, you must not use our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, firm or organisation requesting or receiving the services.

We, us, our means Man and Van Southgate, the provider of removal and van services.

Services means any removal, transport, loading, unloading, packing, storage, waste collection or related services provided by us.

Booking means a confirmed request for services, including the date, time, locations, and any agreed pricing or special requirements.

Goods means any items, belongings or property that we are asked to handle, move, transport or otherwise work with.

2. Scope of Services

We provide man and van services for domestic and commercial moves, collections and deliveries, and related activities in Southgate and surrounding areas. The specific scope of each job will be agreed at the time of booking, including the size of vehicle, number of staff, and estimated duration of the work.

Unless expressly agreed in writing, our services do not include disconnection or reconnection of appliances, dismantling or reassembly of furniture, or the removal of doors, windows or fixtures. If we agree to assist with such tasks, this is done as a courtesy and at the Client’s risk, and we do not accept liability for resulting damage or incompatibility.

3. Booking Process

3.1 Bookings may be made by contacting us and providing accurate details of the work required, including addresses, access conditions, approximate inventory of items, and any special handling needs.

3.2 We may provide either a fixed price quotation based on the information provided, or an estimate based on our hourly rate and expected duration. Any quotation or estimate is valid only for the date and time discussed and may be subject to change if the information supplied by the Client is incomplete or inaccurate.

3.3 A booking is not confirmed until we have expressly accepted it and, where required, the Client has paid any requested deposit. We reserve the right to decline any booking at our discretion.

3.4 The Client is responsible for ensuring that all details in the booking confirmation are correct, including dates, times, addresses and contact information. Any changes must be communicated to us as soon as possible and may affect pricing or availability.

4. Pricing and Payments

4.1 Our charges may be based on a fixed price for the job or on an hourly rate, as confirmed at the time of booking. Hourly rate jobs are charged from the agreed start time, or the time of arrival if later due to the Client, until completion of unloading at the final destination.

4.2 Additional charges may apply for waiting time, delays caused by access issues, extra labour requirements, additional journeys, tolls, parking fees, congestion charges, or services requested on the day that were not included in the original booking.

4.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the services. We may require full or partial payment in advance or a deposit to secure the booking.

4.4 We accept payment by methods agreed at the time of booking. The Client must ensure that payment can be made promptly. We reserve the right to withhold delivery of goods or cease work if payment is not made when due.

4.5 If payment is not received when due, we may charge interest on the overdue amount at the maximum rate permitted by applicable law, and the Client will be responsible for all reasonable costs of recovery, including legal and debt collection costs.

5. Cancellations and Amendments

5.1 If the Client wishes to cancel or amend a booking, they must notify us as soon as possible. Cancellations or major changes may be subject to charges, depending on the notice given.

5.2 If a booking is cancelled by the Client more than 48 hours before the scheduled start time, any deposit paid may be refunded or applied to a future booking at our discretion, less any reasonable administrative costs.

5.3 If a booking is cancelled by the Client within 48 hours of the scheduled start time, we reserve the right to retain part or all of any deposit and to charge a cancellation fee up to a reasonable proportion of the agreed price, taking into account any losses suffered by us as a result of the late cancellation.

5.4 If the Client is not present at the agreed time and location, or fails to provide access or necessary information, this may be treated as a same-day cancellation and charged accordingly.

5.5 We will make reasonable efforts to honour all confirmed bookings. However, in cases of circumstances beyond our control, such as severe weather, vehicle breakdown, staff illness, or safety concerns, we may need to cancel or reschedule. In such cases, our liability will be limited to the return of any deposit or prepayment received for the affected booking, and we will not be liable for any consequential loss.

6. Client Responsibilities

6.1 The Client is responsible for ensuring that goods are properly packed, secured and ready for transport, unless we have expressly agreed to provide packing services.

6.2 The Client must ensure that there is safe and reasonable access to all premises, including adequate parking for the vehicle, clear pathways, and safe stairways or lifts. Any parking restrictions, permits or charges are the responsibility of the Client.

6.3 The Client must not ask our staff to transport any items that are prohibited, illegal, dangerous, flammable, explosive, corrosive, perishable, or otherwise unsuitable for transport, including but not limited to gas cylinders, fuel containers, firearms, ammunition, chemicals, or live animals.

6.4 The Client must ensure that all fragile or high-value items are clearly identified and, where necessary, appropriately packed, labelled, or insured by the Client.

6.5 The Client agrees to supervise the work as far as reasonably possible, to ensure that items are correctly loaded and unloaded and that nothing is left behind. We are not responsible for checking contents of cupboards, drawers, or premises.

7. Excluded and Restricted Items

7.1 We do not accept liability for loss or damage to the following items, whether or not we are made aware of them, unless expressly agreed in writing and appropriately insured by the Client:

Jewellery, watches, precious metals or stones.

Cash, financial documents, or securities.

Collectables, artworks, antiques, or items of significant sentimental value.

Data, electronic files, software, or digital content.

Plants, food, beverages, or perishable goods.

7.2 The Client should keep such items in their own possession and transport them personally wherever possible.

8. Liability for Loss or Damage

8.1 We will exercise reasonable care and skill in providing the services. If loss or damage occurs to goods as a direct result of our negligence, we will, at our option, either repair the item or compensate the Client up to a reasonable amount, taking into account the age, condition and value of the item, and subject to the limitations set out in these Terms and Conditions.

8.2 Our total liability for any claim or series of related claims arising out of a single booking will not exceed the amount paid or payable for that booking, unless a higher limit is expressly agreed in writing before work commences.

8.3 We are not liable for loss or damage arising from:

Defective or inadequate packing by the Client or a third party.

Wear and tear, inherent defects, or pre-existing damage.

Items loaded or unloaded against our advice.

Normal movement, vibration or atmospheric changes during transit.

Acts or omissions of the Client or any third party.

Events beyond our reasonable control, such as accidents caused by third parties, road closures, or extreme weather.

8.4 We are not liable for any indirect or consequential losses, including loss of profit, loss of income, loss of enjoyment, or loss arising from delay, missed appointments or business interruption.

8.5 Any loss or damage must be reported to us as soon as reasonably possible and in any event within 48 hours of completion of the work. We reserve the right to inspect any alleged damage before accepting liability.

9. Delays and Waiting Time

9.1 While we endeavour to arrive and complete work within agreed time frames, all arrival and completion times are estimates and not guaranteed. Traffic, road conditions, previous jobs and unforeseen events may cause delays.

9.2 We will not be liable for any costs or losses incurred by the Client as a result of delays outside our reasonable control.

9.3 Where delays or waiting time are caused by the Client, including but not limited to lack of access, absence of keys or permits, or incomplete packing, we may charge for waiting time at our usual hourly rate.

10. Waste, Rubbish and Disposal Regulations

10.1 We operate in accordance with applicable waste and environmental regulations. We will not carry or dispose of waste in a manner that breaches our legal obligations.

10.2 If the Client requests that we remove unwanted items, rubbish or waste, we will do so only where this is permitted by law and within the scope of our services. Additional charges may apply for collection, transport and disposal of such items.

10.3 The Client must accurately describe any items intended for disposal and must not include hazardous, clinical, chemical, liquid or otherwise controlled waste. We reserve the right to refuse any items that we consider unsafe, unsuitable or unlawful to carry.

10.4 Where disposal services are provided, we will take items to an appropriate facility or reuse channel, but we do not guarantee that items will be recycled or disposed of in a specific way beyond what is required by law and reasonably practicable.

10.5 The Client remains responsible for any waste that is misdescribed or improperly presented and will indemnify us for any fines, penalties or costs (including legal costs) that we incur as a result of relying on incorrect information supplied by the Client about the nature of the items.

11. Insurance

11.1 We maintain insurance appropriate to our activities, subject to the terms, conditions and exclusions of the policy. Our liability to the Client is, in any case, limited as set out in these Terms and Conditions.

11.2 The Client is responsible for arranging any additional insurance cover required for goods, premises or consequential loss, particularly for high-value items or where the value of goods exceeds the limits set out in these Terms and Conditions.

12. Complaints

12.1 If the Client is dissatisfied with any aspect of our services, they must notify us as soon as possible, providing full details of the issue.

12.2 We will investigate any complaint and aim to respond within a reasonable period. The Client agrees to allow us a fair opportunity to inspect and, where appropriate, rectify any issue before taking further action.

13. Termination

13.1 We may terminate or suspend any booking or service immediately if the Client breaches these Terms and Conditions, behaves abusively or unreasonably towards our staff, or requests that we undertake unsafe or unlawful activities.

13.2 In such cases, the Client will remain liable for all charges incurred up to the time of termination, including any costs associated with returning goods to a safe location.

14. Data Protection and Privacy

14.1 We will collect and use personal information about the Client only as necessary to arrange and provide services, manage bookings and payments, and comply with our legal obligations.

14.2 We will take reasonable steps to keep personal data secure and will not sell or disclose it to third parties except where required to perform the contract, enforce our rights, or comply with the law.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising from or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remainder shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

16.3 These Terms and Conditions constitute the entire agreement between the Client and us in relation to the services and supersede any prior discussions, correspondence or understandings.

16.4 We reserve the right to update or amend these Terms and Conditions from time to time. The version in force at the time of the Client’s booking will apply to that booking.
